Terms and conditions

ROBYN BRAGG COACHING™ (RBC) and FLOW TO GROW™ (FTG) are trade names belonging to and operating under THE HYPNO GARDEN, LLC, all being registered with the Ohio Secretary of State.

We provide hypnotic coaching, coaching, hypnosis, yoga/breathwork/mindfulness, reiki and energy work, and education.

We commit to making our clients’ safety and well-being a top priority. Our services are not intended to serve as a substitution for psychotherapy or medical care. If clients believe that they or someone else may have a serious physical or mental health problem, they are advised to call 911 or a crisis hotline or go to the emergency room.

Results may vary from person to person. We guarantee the very best service with the best of intentions using current information and appropriate techniques for each client’s situation. Our services are not meant to diagnose or treat any disease, but rather are intended to provide information, education, transformational experiences, and motivation to help our clients live to their best potential and guide them toward being more effective in helping themselves.

No warranties of any kind are provided (whether express, implied or statutory) with respect to the quality of, or information contained within, provided products and services.

Clients agree to hold Robyn Bragg, acting under Robyn Bragg Coaching™ and providing Flow to Grow™, Happy Whole Human® or other services or products and operating under The Hypno Garden, LLC, harmless for any medical conditions of clients and those the client represents. Results cannot be guaranteed. Clients are responsible for their own decisions, behavior, and results. Programs, services, teachings, materials, and coaching does not provide medical, psychological, medication management, diagnostic, or treatment services.

Hypnosis, hypnotic coaching, or any other service or program offered should not stand alone as the sole medical or psychological intervention for any disorder, and should not be used instead of appropriate medical, dental, or psychological treatment. Any individual with a medical or psychological problem should first consult a qualified healthcare provider for diagnosis and professional advice. Robyn Bragg uses a facilitative approach to hypnosis that is non-directive and empowering. Clients are not told what to do and they will retain full memory and choice. Hypnosis is voluntary and if at any time clients need or want to come out of the relaxed state all clients have to do is think or say the word “Awake.” For this reason, no liability is assumed for clients’ decisions as to how to use the audio or video recordings and files provided, or for the choices clients make. No liability is assumed to any party for any actions or results for adverse situations created as a direct or indirect result of hypnosis, coaching, hypnotic coaching, or other modality sessions or listening to recordings, referrals or other advice given. Hypnosis, self-hypnosis, hypnotic coaching, consulting, coaching, yoga, or other modalities provided are not the same as psychological counseling or any kind of therapy.

Robyn Bragg is working with clients solely as a coach, a hypnotic coach, a hypnotist, an energy work or reiki practitioner, or a yoga, breathwork, and mindfulness instructor, and NOT as a doctor, a pharmacist, a medical professional, a therapist, or a dietitian. Therefore, she does not offer clinical, medical, or psychological advice, prescribe any treatments, provide medication management or personalized pharmaceutical advice, or perform other pharmacy services during sessions. Robyn Bragg works as a Registered Pharmacist OUTSIDE of her work within Robyn Bragg Coaching™, Happy Whole Human®, or The Hypno Garden, LLC.

Before starting any smoking cessation, anxiety management, stress management, weight loss or weight reduction program, clients should ALWAYS seek medical advice first. Although Robyn Bragg is fully available to support clients in their efforts and decisions to improve their lives and may provide options for dietary changes to incorporate into a client’s customized plan or program, she does not provide advice on diet. Clients co-create their plan and program and services are intended to assist in achieving a healthy diet and lifestyle. We are not a medical organization and cannot give medical advice or make any diagnosis.

If clients are experiencing panic attacks, feeling suicidal, having homicidal thoughts, or likely to be a harm to themselves and others they must be in the care of a primary licensed health professional (preferably a psychiatrist or psychologist) and have a waiver signed so we collaborate as complementary practitioners. Coaching does not treat illness or pathology. Only qualified healthcare professionals can provide accurate diagnosis of suicidality, depression, and alcohol/drug problems or other mental illnesses.

Clients should be aware that hypnosis or hypnotic coaching may not be a good fit for them if they have certain medical conditions or diagnoses, including but not limited to:

  • Any condition that limits a clients ability to focus and concentrate
  • Known psychological problems or psychosis
  • Seizure disorders
  • Delusional/paranoid disorders
  • Eating disorders (anorexia, bulimia, or other)
  • Bipolar disorder

Clients are requested to be honest and up-front regarding any of these or similar medical conditions and diagnoses, indicating such on intake forms and discussing them openly with Robyn Bragg. These conversations and disclosures are important and necessary to create the most safety possible and to provide ethical and appropriate services. We will work together to determine what services are suitable and clients may be asked to inform and ask advice from their primary medical and mental health providers before enlisting services. A waiver allowing communication between all parties may be required to work together. All potential and current clients are expected to notify their primary and other healthcare providers regarding the services they are receiving, as appropriate, and a letter will be provided for this purpose. No signature is required on this letter unless specifically requested by Robyn Bragg.

Also, the client is expected to discuss any health difficulties which arise during the course of receiving our services immediately so that we can provide the client with an appropriate referral.

The material on our websites and other online presence is for informational and educational purposes only. It is a client’s responsibility to verify to their own satisfaction the information supplied before making any decision and to consult registered medical practitioners or healthcare professionals concerning the information presented.

We do not assume any legal obligation to follow up with individuals outside of sessions unless otherwise specified. We assume no liability arising from the application or use our products or services, nor for any loss or damage (whether direct or indirect) caused by any errors, omissions or statements of any kind contained on www.robynbraggcoaching.com, its publications or products, our other business online presences, or on Robyn Bragg’s personal or professional social media, Facebook, Instagram, YouTube, LinkedIn, or other media or online presence.

Coaches Do Not Tell Clients What to Do or How to Do It

Since the goal is to help clients mature, coaches do not tell them what to do or how to do it. Coaches do, however, discuss what is happening in their lives with them and provide support such as helping them to come to clarity through brainstorming, teaching them tools, and leading them through exercises. We provide resources and referrals as appropriate. Coaches discuss any issues clients bring us: professional, personal, and relational.

Coaching Content

Robyn Bragg, acting as a coach or hypnotic coach, asks questions that prompt the client to assess the challenges the client is facing and to determine appropriate ways forward.

The Coach-Client Relationship

Coaches and hypnotic coaches are not and should not be authority figures. Instead, we are the stewards of the process and are responsible for measuring progress in terms of what the client is learning about themselves and the degree to which clients demonstrate that they are better equipped to meet the complex challenges in their lives.

Setting Goals

A coach may make recommendations for what the goals of the session will be, but the client makes the final decision.

Appointment Scheduling Policy

Booking, changing, and canceling appointments is a client responsibility and can generally be done by the client via the online scheduling system. In case of exception, booking instructions will be provided to the client.

Cancellation Policy

Robyn Bragg respects clients’ time and asks clients to respect the value of her time. If clients make an appointment, it will be held for them. As everyone experiences unexpected setbacks, one grace last-minute cancellation or no show is permitted. Beyond that, if clients either are not available for a scheduled session (No Show) or need to cancel within 24 hours of the scheduled session (Last Minute Cancellation), clients are responsible for payment in full and will not be issued a refund or credit.

Communications

In sessions, we may address specific personal or health improvement projects, business successes, or general conditions in the client's life or profession. Other services include values clarification, brainstorming, identifying plans of action, examining modes of operating in life, asking clarifying questions, holistic mind/body awareness exercises, mediation, hypnosis, yoga, mindfulness, breathwork, and requests or suggestions for action.

Throughout the working relationship, we will engage in direct and personal conversations either in person or remotely (via telephone, online video platform, email, text message, the Voxer app, etc.) as agreed upon together.

The client understands that a successful experience requires a co-created and collaborative approach. In the coaching relationship, the coach plays the role of a facilitator of change, but it is the client's responsibility to enact or bring about the change.

Privacy

The client can, at any point in the coaching session, declare his/her preference not to discuss a specific issue, by simply stating that they would rather not discuss this issue. Additionally, the client can opt to not participate in an exercise suggested by the coach. The coach agrees to respect this boundary and will not attempt to forward the conversation further along those lines.

Minors

Robyn Bragg currently works only with adults of age 18 or older, and all services online or in person are intended for adults only.

Coaching Payment and Refund Policy

Fees for sessions are due as agreed between the client and Robyn Bragg and are non-refundable unless otherwise specified.

Agreement to Work it Out

If the client or coach believes the coaching is not working as desired, they agree to communicate and take action to work out any difficulties and do their best to get back on track to their mutual satisfaction.

Term and Termination

We and our clients agree to provide as much notice as possible if one or both desires to discontinue coaching. Otherwise, the coaching will continue for the duration of the contracted period. These terms and conditions are applicable to clients upon signing this contract. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

If a client decides, or if we make the professional decision, that sessions are no longer productive, either of us may say so and discontinue the coaching relationship. Abuse, sexual harassment, or any other mistreatment will not be tolerated. In these cases, unused sessions or remaining program benefits are non-refundable unless otherwise specified.

Confidentiality, Research, and Reporting

Coaching session records are confidential. Robyn Bragg may share some broad details of sessions in consultation with Dr. Lisa Leit of HAPPY WHOLE HUMAN®, her Mentor, if she feels Dr. Leit’s expertise may be helpful in providing clients with the most effective support. All intake forms and self-assessment results are confidential. Self-assessment results are aggregated anonymously to generate benchmarks, for research, and for reporting purposes.

Coaches do not keep in-depth session notes. Any cursory notes and opinions will only be released if concerns arise about unethical behavior on the part of the coach, or strong evidence that a client might be of harm to herself or someone else (by law, any mentions of child abuse or suicidal or homicidal intent MUST BE REPORTED).

Robyn Bragg agrees to hold any contact or personal information about clients confidential.

In instances where another party (such as a parent or employer) pays for coaching sessions, a strict confidentiality policy is in effect to protect clients (those undergoing coaching). Unless the primary client signs a waiver form giving permission to talk to specified other parties, coaching session records are confidential. If clients wish for their coach to speak to someone outside coaching interactions, then clients need to give written permission (original letter, fax or email) to do so.

Exceptions to confidentiality relate to circumstances such as indications of intent to seriously harm themselves or someone else, plans to commit serious criminal acts, or child abuse. Otherwise, all client information is confidential.

Typographical Errors

In the event that a service or product is mistakenly listed at an incorrect price, ROBYN BRAGG COACHING reserves the right to refuse or cancel any orders placed for the incorrect price. We reserve the right to refuse or cancel any such orders whether or not the order has been confirmed and clients’ credit card charged. If a client’s credit card has already been charged for the purchase and their order is canceled, a credit will be issued to the client’s credit card account in the amount of the incorrect price.

Third-Party Links

In an attempt to provide increased value to visitors, the robynbraggcoaching.com website may link to sites operated by third parties. However, even if the third party is affiliated with robynbraggcoaching.com, ROBYN BRAGG COACHING has no control over these linked sites, all of which have their own, separate, privacy and data collection practices. These linked sites are only for clients’ convenience and therefore clients access them at clients’ own risk. Nonetheless, we seek to protect the integrity of our website and the links placed upon it and therefore we request any relevant feedback on not only our own site, but for sites we link to as well (including if a specific link does not work). All educational supporting materials that we provide are used for research, supplemental, and instructional purposes according to the Fair Use Provision of the Copyright Protection Act.

We abide by all social media, internet, or internet search sites’ Acceptable Use Policies. These sites are expected to comply with the provision of the Digital Millennium Copyright Act that requires them to remove content when asked by the copyright owner. We strive to give proper attribution when appropriate. If copyrighted content is accidentally presented on the site and people wish to have it removed they are invited to email us and the relevant content will be removed immediately.

Payments

We reserve the right to change service and content options (including pricing, program contents, eligibility for particular features, etc.) without notice. Clients agree that we may charge their payment method for any services and/or products purchased and for any additional amounts (including any taxes and late fees, as applicable) that may be accrued by or in connection with their account. The total price will include the price of the product and/or service plus any applicable sales tax; such sales tax is based on the bill-to address and the sales tax rate in effect at the time clients download the product. Tax will be charged only when required.

Indemnification

Clients agree to indemnify, defend, and hold harmless Robyn Bragg, ROBYN BRAGG COACHING, THE HYPNO GARDEN, LLC, and its employees, agents, licensors and suppliers (collectively the “Service Providers”), from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to clients’ account (including negligent or wrongful conduct) by clients or any other person.

Participation Disclaimer

We do not and cannot review all communications and materials posted to or created by users accessing www.robynbraggcoaching.com and Robyn Bragg’s personal or professional social media and related websites, and we are not in any manner responsible for the content of these communications and materials. Clients acknowledge that because of the ability to view and distribute user-generated content on the site, Robyn Bragg and ROBYN BRAGG COACHING are merely acting as a passive conduit for such distribution and are not undertaking any obligation or liability relating to any contents or activities on the site. However, we reserve the right to block or remove communications or materials that are determined to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable at our sole discretion.

Use of Website

Harassment in any manner or form on our websites, online or social media sites, or via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden.

Impersonation of others is prohibited. Clients may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party, or which may otherwise give rise to liability or violate any law.

Clients may not upload commercial content or use our sites to solicit others to join or become members of any other commercial online service or other organization. Clients agree to protect, and ensure that all parties that the client represents protect the confidentiality of all ROBYN BRAGG COACHING representatives, clients, and all content herein, including the process, methods, information, media attachments, audio and video files, and all aspects–questions, scales, structure, order, platform, design, results, comments and recommendations of ROBYN BRAGG COACHING. The HAPPY WHOLE HUMAN™ Intake Form and Self-Assessment, as well as the entire content included on the www.happywholehuman.com site, including but not limited to text, graphics or code is copyrighted as a collective work under the United States and other copyright laws, and is the property of HAPPY WHOLE HUMAN LLC.

Permission is granted to electronically copy and print hard copy portions of the www.robynbraggcoaching.com site for the sole purpose of placing an order with us or purchasing our products. Clients may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for their own non-commercial use, or to place an order with us. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited unless explicitly authorized by Robyn Bragg. Clients further agree not to change or delete any proprietary notices from materials downloaded from the site.

Notice

We may deliver notice to clients by means of e-mail, a general notice on the site, by postal service to the address clients have provided to us, or by other reliable method.

Warranty Disclaimer

Our materials and products are provided “as is” and without warranties of any kind, whether expressed or implied, to the fullest extent permissible pursuant to applicable law, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. We do not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. We do not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to all clients.

Limitation of Liability

We shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on our websites or the performance of the products, programs, or services offered, even if RBC has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to all clients.

The results clients achieve will be in direct proportion to the effort clients apply. It is their responsibility to verify to their own satisfaction the information supplied before making any decision based upon the information. Clients are responsible for their own decisions and actions and hold us harmless of any liability for their personal decisions as to how they apply the tools, support, and information provided.

Other Protections

Our websites are copyrighted by us. Use of any website-included materials must be approved by Robyn Bragg. Further, our customers, coaching clients, and HAPPY WHOLE HUMAN® Self-Assessment test-takers expressly agree to protect the confidentiality of all of our materials and processes.

Miscellaneous

The use of the our websites shall be governed in all respects by the laws of the state of Ohio, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods.

Clients agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to our websites (including but not limited to the purchase of our programs, services, and products) shall be in the state or federal courts located in Ohio. Any cause of action or claim clients may have with respect to the site or purchases from us must be commenced within one (1) year after the claim or cause of action arises. Our failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. We may assign our rights and duties under this agreement to any party at any time without notice to clients.

This agreement is not a complete statement of our rights in connection with this matter, and nothing in this agreement constitutes an express or implied waiver of any rights, remedies, or defenses of Robyn Bragg, ROBYN BRAGG COACHING, or THE HYPNO GARDEN, LLC, in connection with this matter, and all such rights are expressly reserved.
